Terms of service

Last updated 2026-08-23. These terms apply to film production services sold under the Daylight name by Gabriel Homoky, sole trader, Hungary ("I", "me"). They are written to be read, not skimmed; if anything here is unclear, email me before you order.

1. Ordering

An order is confirmed when you accept a written quote (an email reply is fine) and pay the deposit. The quote states the scope, the price, the delivery date and the number of change rounds. Anything not in the quote is outside the order.

2. Payment

Half of the price is due before work starts, half when the final files are delivered. Card via Stripe or bank transfer in USD (EUR and GBP on request). Prices exclude VAT. For a business customer outside the European Union, including the United States, no VAT is charged, so the invoice matches the price quoted. An invoice is issued for every payment.

3. Your materials

You confirm that your community has the right to use the photographs, plans, facts and logos you send me or that I take from your public website, and that I may use them solely to produce your film. I do not publish your materials or your film without your permission. Concept samples are the exception: they are built only from photographs your community has already published, are clearly labeled as samples, are not indexed by search engines, and are taken down on request the same business day.

4. Residents, staff and visitors

I do not use photographs that show an identifiable person, and I do not add people to a film. If you send a photograph with a person in it, I will ask for another or crop the person out. You remain responsible for any consent that your own photographs required when they were taken.

5. Deliverables and changes

You receive the film in the formats stated in the quote (normally 16:9 and vertical). One round of changes is included unless the quote says otherwise. If the first cut is not usable and one round of changes cannot fix it, the deposit is refunded and the order ends.

6. License and ownership

On full payment I grant your organization a broad, perpetual, worldwide, irrevocable, royalty-free license to use, copy, edit, distribute and sublicense the delivered film for marketing your community and your organization, and I assign to you whatever copyright subsists in the delivered work. Part of the film is produced with AI tools; unmodified AI-generated elements may not attract copyright protection in some jurisdictions, including the United States and the European Union, and I do not warrant that you will hold an enforceable copyright in those elements. My templates, tooling and process remain mine.

7. AI disclosure

The camera motion in the film is generated by software from your photographs. Every delivered film carries a short "AI-assisted camera motion" notice on the end card. You agree not to remove that notice where disclosure is required by law (for example the EU AI Act, Article 50, or applicable advertising rules).

8. Facts on screen

Every fact on screen (care levels, apartment types, phone numbers, addresses) is taken from the material you provide or from your public website, and is shown as you publish it. You are responsible for checking those facts in the delivered film before you publish it.

9. Liability

My total liability under an order is limited to the amount you paid for that order. I am not liable for indirect losses, lost move-ins or lost profits.

10. Commercial email

If I wrote to you first, that message was a commercial email and it was sent to follow the United States CAN-SPAM Act: it says what it is, it shows my postal address, and it carries a working opt-out. Reply "no" to any message and you will not hear from me again. I process every opt-out the same business day, well inside the ten business days the law allows, and I never sell or share your address.

11. Governing law

Hungarian law applies, because that is where I am registered. Disputes go to the competent courts of Hungary, without prejudice to mandatory rules that protect you in your own state or country. In practice, if something goes wrong, email me first: the refund rule in section 5 is meant to settle most of it.
